This Location-Specific Privacy Rights and Information Notice (“Privacy Notice”) supplements the main Track3D Privacy Policy by providing additional information about how Constructn Corp (operating as Track3D) collects, uses, retains, and discloses personal information.

In addition to the information described in our general Privacy Policy, certain US states (such as Virginia, Colorado, Connecticut, Utah, etc.) require us to provide specific details regarding how Track3D collects, uses, retains, and discloses personal information.

1. Personal Information We Collect We collect the following categories of personal information to provide our AI-Powered Reality Intelligence Platform for Construction:

  • Identifiers and Contact Information: First and last name, company email address, mobile phone number, and account login credentials.
  • Professional Information: Company name, job title, designation, and user role (e.g., General Contractor, Owner, Trade Partner).
  • Electronic Network Activity & Usage Data: Internet Protocol (IP) address, browser type and version, pages visited on app.track3d.ai, time spent on pages, unique device identifiers, mobile operating systems, and diagnostic data.
  • Communications Data: SMS content, toll-free messaging metadata, and direct communications with [email protected] or our AI algorithms.

2. Sources of Personal Information We collect personal information from the following categories of sources:

  • Provided Directly by You: Information entered into web forms, registration portals, or sent via email/SMS.
  • Automated Collection: Data generated automatically from your use of the Track3D VisualTrack, ProgressTrack, or DeviationTrack platforms.
  • Third-Party Integration: Information obtained from integrations you choose to connect with our Reality Intelligence Platform.

3. Business or Commercial Purposes for Collecting Data We use your personal data for the following purposes:

  • Product and Service Delivery: To operate our reality data capture platform, unify visual documentation, and manage user accounts.
  • Product Improvement & AI Processing: To train and improve Track3D’s proprietary AI algorithms for automated progress tracking and deviation detection.
  • Customer Support & Communication: To address technical issues, process SMS responses for informational purposes, and respond to inquiries.
  • Business Operations: For data analysis, identifying usage trends, preventing security vulnerabilities, and platform maintenance.

4. Categories of Personal Information Disclosed for a Business Purpose In the preceding 12 months, we have disclosed Identifiers, Professional Information, and Usage Data to:

  • Sub-processors & Service Providers: Entities that provide infrastructure hosting, data analysis, and SMS processing (e.g., Twilio for toll-free messaging).
  • Affiliates: Parent companies, subsidiaries, or companies under common control with Constructn Corp.
  • Business Transfers: Potential partners or acquirers in the event of a merger, sale of assets, or financing.

5. Categories of Personal Information Sold or Shared Track3D does not sell consumer personal data to third parties for monetary compensation.  Furthermore, Track3D strictly limits the use of SMS/communication content—we do not use text messaging data for marketing, profiling, or resale purposes.

 

California Privacy Rights (CCPA / CPRA)

If you are a California resident, the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), grants you specific rights regarding your personal information:

  • Right to Know and Access: You have the right to request details about the categories and specific pieces of personal information we have collected about you, the sources of that data, and our business purposes for collecting it.
  • Right to Request Deletion: You have the right to request that we delete your personal information, subject to certain exceptions (such as retaining data necessary to complete a transaction, provide customer support, or comply with legal obligations).
  • Right to Request Correction: You have the right to request that we correct any inaccurate personal information we hold about you on the Track3D platform.
  • Right to Opt-Out of “Selling” or “Sharing”: While Track3D does not sell data for monetary value, California law defines “sale” and “share” broadly. You have the right to opt out of data sharing for cross-context behavioral advertising (if applicable).

Track3D is heavily operational in the United States and India. For our users located in India, your data is processed in accordance with the applicable Indian data protection framework, including principles recognized under the Digital Personal Data Protection (DPDP) Act:

  • Right to Access and Information: You may request a summary of the personal data being processed by us and the identities of all other Data Fiduciaries/Data Processors with whom the data has been shared.
  • Right to Correction and Erasure: You have the right to request the correction of inaccurate data or the deletion of data once the purpose for its collection has been fulfilled and it is no longer required for legal compliance.
  • Right to Grievance Redressal: You have the right to readily available means of grievance redressal provided by Track3D.
  • Consent Withdrawal: You may withdraw your consent for data processing at any time, acknowledging that this may impact our ability to provide you with access to the Track3D platform.

 

Notice Regarding EU/EEA Users

Restriction of Services: Please be advised that Track3D (Constructn Corp) currently provides its services exclusively within the United States and India. As explicitly stated in our Privacy Policy, users from the European Union (EU) or European Economic Area (EEA) must not register for or access the services of the company. Consequently, the General Data Protection Regulation (GDPR) does not apply to our operations at this time.

This will typically involve confirming the email address associated with your Track3D account and validating your affiliation with the General Contractor, Owner, or Trade Partner associated with the account.

Track3D does not charge a fee to process or respond to your verifiable privacy requests unless they are excessive, repetitive, or manifestly unfounded.
